4-8-98 On KABC AM 790, Noon. Dennis Prager bought two goats this morning and he worried about litigation. What if kids came over to play with the goats and someone got hurt. Could Prager be sued for negligence? Prager's show today was filled with examples of stupid lawsuits and threats to sue. Reminds me of the stupid letter I got from Dennis Prager's lawyer the other day. When he receives negative media attention, Prager, at times, seems quick to threaten to sue. When Dennis Prager's son David was eight, he was bit by a neighbor's dog and had to have 60 stitches. Many folks told Dennis to sue but he did not. People phoned in to give examples of things they feared allowing children to do on their property, because of possible litigation .From a skateboard ramp, to a trampoline There is a dark undercurrent in American life. It's like the smog in LA. When you live here, you don't notice it, until you fly in through a dark cloud or notice the mountains on a clear day. The legal system is awful, a dark cloud on our nation. Prager says this litigation explosion is worse than kids smoking, worse than second hand smoke. Prager believes strongly in "Loser Pays," whereby the loser of a court case pays the court costs of the winner. DP says there should be a limit on the number of lawyers in politics. Dennis began the show laughing that there are two new additions in the Prager house, two goats. He said that he just loves them and that they are so cute with the chickens. He was laughing because of a thought that entered his mind just when he was thinking about how cute they are. He said that he was looking at the goats and thinking about how sweet it will be for friends of his five year old, Aaron, to come over and play with the goats. Then the thought, "oh no, what if a goat bucks one of Aaron's friends? I could loose everything I own in litigation." Dennis was laughing a sarcastic laugh and said that we live in such a litigious society that he is scared to let his son's friends pet his goats, animals that are normally at all petting zoos. Then, Dennis opened the show to callers who either have been sued by neighbors or afraid of lawsuits. This turned into a three hour hilarious (in a sad way) show. One example, was a man who called up to say that he built a skateboard ramp for his sons in the front yard. Neighbor boys wanted to use it. So, he told them to go home and have their parents sign a paper stating that if the boys get hurt on the ramp, they wouldn't sue. The boys came back to the man and said that their parents wouldn't sign the paper. Another example, is a woman called up to say that she had to agree that there would be no flowers or rice throwing at her wedding. The church said they were afraid of litigation should someone slip on the rice or flower pedals. Another woman called to say that she couldn't let local children play on her trampoline. Dennis asked how parents have birthday parties for their kids? Suppose a kid slips on spilled punch or ice cream? Then he laughed, and thought about the ramifications if some milk from his goat accidentally landed on a kid's foot where there was an open sore and it got infected. The show went on with lots of examples given by callers over the fear of being sued. |
